Someone advised me once never to read license agreements, and I've come to agree. However, I'm sure that if I put a license agreement on an SDK like the Glide API, it would say that you're not allowed to reverse engineer the drivers or to do anything to damage the company's success.

(Not that I've read the 3dfx agreement.)

If this is the case, a person doing something like BigRRed with my hypothetical API would be open to legal action if it were worth my time to stop them before they got anywhere. Mind you, if they were DONE before I realized it, there wouldn't be much point in wasting lawyer's fees to stop the unstoppable spread of the complete driver.

(Not that I know if 3dfx would do such a thing.)

So, a person writing something like BigRRed would be best off to finish it BEFORE spreading it or, god forbid, talking to game companies about it.

(Not that I have any idea what's in the 3dfx SDK license agreement.)

PS: In case it wasn't clear, I didn't read the 3dfx Glide SDK license agreement and do not know that it says exactly what I outline above.
